Abstract

This paper analyzes the relevant legislation in the field of consumer protection in
the European Union and gives a comparative analysis of the legislation of the
Republic of Serbia and Bosnia and Herzegovina on their path to the European Union.
All member states, as well as candidate countries or potential candidates for EU
membership, have to introduce into the national legislation the adequate standards
of consumer protection regulated by primary and secondary EU legislation. The
Republic of Serbia and Bosnia and Herzegovina have introduced the specific
legislation regulating this area, making it separated from the lex generalis regulations
of the Law of Obligations, which indicates the importance of this area and the need
for reform of the most important legislation in the field of contractual relations, the
Obligations Act from 1978, which must be adapted to new social trends, and regional
and universal integration processes and among other important provisions it should
improve the standards of consumer rights protection.
